Participation in the Amazon Flex Rewards Program (the “Rewards Program”) is subject to these terms and conditions (these “Rewards Terms”) which form part of the Amazon Flex Independent Contractor Terms of Service (the “Flex Terms”) (collectively the “Rewards Program Terms”).
Please read these Rewards Terms carefully. By participating in the Rewards Program, you agree to be bound by the Rewards Program Terms. Your participation in the Amazon Flex Program will automatically accrue Points under the Rewards Program. However, you are under no obligation to access or participate in the Rewards Program (i.e., by signing up to Onsi or Preferred Scheduling, or otherwise redeeming Rewards). ELIGIBILITY
To participate in the Rewards Program, you must (1) meet all eligibility requirements to be a delivery partner under the Flex Terms; and (2) have an Amazon Flex account in active standing of Fantastic, Great or Fair. All eligible delivery partners will automatically accrue Points under the Rewards program. However, you are under no obligation to access or participate in the Rewards program (i.e. by signing up to Onsi or Preferred Scheduling, or otherwise exhausting Points / redeeming Rewards).
REWARDS PROGRAM LEVELS
The Rewards Program offers four membership levels (“Rewards Levels”): Rewards Level 1, Rewards Level 2, Rewards Level 3, and Rewards Level 4. Rewards Levels unlock access to certain rewards (“Rewards”), whether offered through Amazon or through a third-party service provider. Each Rewards Level includes its own Rewards as well as the Rewards of the preceding Rewards Level. Each Rewards Level requires a minimum number of points earned to access a set of Rewards. The Points thresholds required to reach each Rewards Level can be found in the Rewards details page in Your Dashboard in the Amazon Flex App.
EARNING POINTS
Delivery partners can earn points (“Points”) to access the different Rewards Levels and the Rewards offered in each Rewards Level. Delivery partners having a standing of Fantastic, Great, or Fair will be able to earn Points and access Rewards.
Delivery partners who have a standing of Poor will not earn Points when making deliveries until their standing is improved to Fair, Great or Fantastic. Delivery Partner standing is awarded by Amazon in its sole discretion based on a number of factors, including, without limitation, reliability and delivery quality. Learn more about what affects your standing by navigating to the Read FAQs section in the Amazon Flex App (Amazon Flex App > Your Dashboard > Standing Details > Questions? Learn more.) Delivery partners will earn 10 Points per Attended Block and 1 Point per Delivery Opportunity. “Attended Block”” means a delivery block for which you accept and complete in accordance with the Flex Terms. Delivery blocks are subject to block availability. Amazon makes no guarantee that blocks will be available. “Delivery Opportunity” means for Attended Blocks, each package for which you make an affirmative, good faith attempt to deliver consistent with the Flex Terms. Whether you accrue Points will depend on your standing prior to beginning deliveries of an Attended Block. Delivery Partners with Poor standing
prior to commencing an Attended Block will not accrue Points for that Attended Block, regardless of whether their standing improves during the course of that Attended Block. Delivery Partners with a standing of Fair, Great or Fantastic prior to commencing an Attended Block will accrue points for that Attended Block.Amazon reserves the right to offer additional Points for certain periods of time, in its sole discretion. Any such offer of additional points will be subject to the
Amazon Flex Promotions Terms and Conditions ("Promotion Terms").
Points have no cash value and are used solely to determine your Rewards Level. Points may be revoked if Amazon reasonably believes, that Points were earned through or in connection with any fraud, abuse of the platform, or in violation of the Rewards Program Terms.
MAINTAINING YOUR LEVEL
Each points earning period (“Points Period”) is a three-month period, and there are four Points Periods each year (January 1st through March 31st, April 1st through June 30th, July 1st through September 30th and October 1st through December 31st). The number of Points earned during a Points Period will determine the Rewards Level and, therefore, the Rewards that can be accessed. When the required minimum number of points is reached in a Points Period, the delivery partner will gain access to the new Rewards Level immediately, or within 24 hours, and enjoy that access for the remainder of the current Points Period and through the following Points Period. Points expire and reset to zero at the end of every Points Period. For example, in case a delivery partner accumulated the number of Points required to unlock Rewards Level 2 on February 2nd, they will have access to Rewards Level 2 until June 30th, the end of the following Points Period.
Once you unlock a higher Rewards Level, you will start to access the Rewards from the higher Rewards Level. All Rewards will become available within 2 weeks.
At all times that a delivery partner has a standing of Poor, such delivery partner will not be able to access any new Rewards until their standing is improved to Fair, Great or Fantastic. However, delivery partners will not lose Rewards for which they have already enrolled in or purchased (e.g. gift cards). Delivery partner standings will be updated every day.
For clarity, Rewards unlocked, but not otherwise enrolled in or purchased prior to receiving the Poor standing, will be made available to a delivery partner again after their standing is improved to Fair, Great or Fantastic.HOW TO VIEW YOUR POINTS BALANCE; DISPUTES
You can view your current Points balance by visiting the Points History Tab from the Rewards details page in Your Dashboard. Please report any errors or omissions related to delivery activity or Points posted to Your Dashboard as soon as practicable by contacting Amazon as noted in the “Contact Us” section below.
It may take approximately 72 hours after the Attended Block for your Points balance to update. In the event of an outage of the Amazon systems or other technology beyond Amazon’s reasonable control, your Points balance update may be delayed. Additionally, if an outage occurs near the end of a Points Period, any Points earned during this outage will be applied retrospectively, such that any higher Rewards levels that would have been unlocked during the outage will become available.
ACCOUNT TERMINATION AND SUSPENSION
A condition of eligibility is to maintain an active Amazon Flex account pursuant to the Flex Terms.
If your participation in Amazon Flex is terminated for convenience by you, or is otherwise suspended pending review or pursuant to Amazon's termination for cause, all Points associated with the Rewards Program and any Rewards shall be forfeited immediately upon the giving of notice of that termination or suspension, in accordance with the terms of the specific Reward, as detailed below. If Amazon suspends your account pending the outcome of a review, but does not terminate your account at the conclusion of that review, your accrued Points and redeemed Rewards will be reinstated upon your account being reactivated. If delivery partner participation in Amazon Flex is terminated for convenience by Amazon, delivery partners will not be able to access any new Rewards. However, delivery partners will not lose Rewards for which they have already enrolled in or purchased (e.g. gift cards).
REWARDS PROGRAM CHANGES AND REWARDS PROGRAM TERMINATION
Amazon reserves the right to modify, suspend or discontinue the Rewards Program, or any part thereof, in accordance with the Flex Terms, including, but not limited to modifications that: (1) govern how Points are earned on and after the date of change; (2) change the number of Points required to access a Rewards Level; (3) change the specific Rewards offered in each Rewards Level; or (4) change any other requirements necessary to obtain Rewards within a Rewards Level. No Points will be earned after the effective date of termination. Any and all changes and/or amendments to these Rewards Program Terms will become binding upon all delivery partners and non-materially adverse modifications effective immediately.
ASSIGNMENT OF RIGHTS
Amazon’s rights and obligations under the Rewards Program may be assigned or transferred by Amazon to any third party at any time, and if such transfer takes place, then performance shall be the responsibility of that entity.
REWARDS DETAILS AND ADDITIONAL TERMS
Rewards are not redeemable for Points or cash and have no cash value. Rewards may also only be available in certain locations and to some delivery partners. Reward details, terms and limitations are described below and are hereby incorporated into these Rewards Program Terms. Rewards provided by third parties may require additional action by you and may be subject to additional terms and conditions provided by such third parties, including your use of the Onsi App (the “Onsi App”). For more information about third party Rewards partners, please see
here. Delivery partners are responsible for all taxes that may be owed as a result of receiving the Rewards. Subject to the ACL Notice below, Amazon is not responsible for the products or services offered by third parties.
To ensure the success of the Rewards Program, Amazon may collect information on such third-party Rewards-based transactions for information and reporting purposes, in each case, subject to the terms to which you and the third-party Reward provider have agreed.
The following list includes examples of the current Rewards provided by participating third parties. Please note that offers from third parties, including but not limited to the qualifications for accessing the Rewards, as well as the identities of the third parties themselves, are subject to change at any time in Amazon’s reasonable discretion:
• Rewards made available to delivery partners through the Onsi App.
• Rewards at participating third parties with which Amazon has negotiated exclusive Rewards.

1. What is Onsi and how do I access Rewards?
We've partnered with Onsi to provide delivery partners with access to deals and discounts to help you make your earnings go further.
To access the Rewards available through Onsi, you will need to set up an Onsi account and download the Onsi App. Go to
Amazon Flex App > Menu > Your Dashboard > Rewards Details > Level Details and click ‘Access Onsi App’. This will open the Onsi website. Follow the directions to create an account using your email address. Then, download the Onsi App and log in to see your Rewards.
2. What if I have questions about the Rewards in the Onsi App?
You can learn more about the Onsi App and your available rewards by going to
My Account > Frequently Asked Questions. If you have additional questions, you can contact Onsi support at: support@onsi.com.
3. What is Preferred Scheduling?
With Preferred Scheduling you can enjoy special reserved offers targeted to your preferences. And, you’ll have more time to accept them! These special reserved offers are called Rewards reserved offers. They will appear in addition to the offers you already see on the Offers page and will indicate that they are linked to your Rewards Level. The number of Rewards reserved offers that you’ll see is based on availability of offers that match one or more of your Preferred Scheduling preferences. You will be able to set these preferences when you unlock Rewards Level 2. As you level up, you are more likely to see a higher number of Rewards reserved offers.
The extended time you’ll have to accept Rewards reserved offers will be based on your rewards level.
Rewards level 2: 15 minutes
Rewards level 3: 20 minutes
Rewards level 4: 30 minutes.
To set your Preferred Scheduling preferences go to the
Amazon Flex App> Menu > Your Dashboard > Rewards Details. You can select up to 3 preferred delivery stations, and up to 3 day and time combinations that work best for you. You will be able to set these preferences once you unlock Rewards Level 2, and they can be updated at any time. After you set your preferences, Rewards reserved offers will appear in the Offers page based on the availability of offers that meet one or more of your preferences. The Preferred Scheduling preferences you set will only apply to these additional Rewards reserved offers. They will not limit the offers you see on the Offers page.
IMPORTANT NOTICE ABOUT YOUR AUSTRALIAN CONSUMER LAW RIGHTS ("ACL Notice")
Nothing in these Rewards Terms or the Amazon Flex Terms is intended to (i) override any express commitments Amazon gives to you for particular Amazon Services (for example, commitments Amazon gives to provide a refund of fees in certain circumstances) ; (ii) exclude, restrict or modify any right or remedy you have in statute including under the Australian Consumer Law or otherwise to the extent that that right or remedy cannot be excluded, restricted or modified under law; or (iii) limit or exclude our liability to you for losses, to the extent such loss is caused by our gross negligence, fraud, criminal conduct or willful misconduct; or (iv) require any indemnity you provide to us under these Rewards Terms to extend to losses to the extent caused or contributed to by Amazon. Any disclaimer, exclusion, or limitation in these conditions applies as provided for in these conditions to the full extent permitted by law and subject to any such non excludable right or remedy.

The Rewards Program and/or any of its features, including Rewards, may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of our control. We are not responsible for any unavailability, interruptions or errors of the Rewards Program, its features or any Rewards that are not within our control. The Rewards Program and all the information accessible through it are provided for informational purposes only on an “as is” and “as available” basis. Amazon, its affiliated entities, and third-party Rewards providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Rewards Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, and subject to the ACL Notice above, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.The merchants and third-party service providers that participate in the Rewards Program are not affiliated with Amazon and are not sponsors or co-sponsors of the Rewards Program. All participating merchant and third-party service provider names, logos, and marks are used with permission and are the property of their respective owners. Participating merchants and third-party service providers are responsible for the quality and performance of any products or services they provide. To the fullest extent permitted by applicable law, and subject to the ACL Notice above, Amazon is not responsible for any aspects of the Rewards, products and services provided by participating merchants or third-party service providers.
LIMITATION OF LIABILITY
Except as set forth herein, all disputes arising out of or relating to these Rewards Terms will be governed in accordance with the Flex Terms.
By participating in the Rewards Program or redeeming Rewards, you agree that Amazon, its affiliates and subsidiaries, and its officers, directors, employees, representatives and agents, including any third party providing rewards in the Rewards Program (collectively, the “Released Parties”) will have no liability or responsibility whatsoever for, and shall be held harmless by you for, any liability for any injuries, losses or damages of any kind (including, without limitation, direct, indirect, incidental, special, consequential, or punitive or exemplary damages) to persons, including personal injury or death, or property arising in whole or in part, directly or indirectly, from any action taken or neglected to be taken with regard to the Rewards Program, except where that liability arises out of Amazon's gross negligence, fraud, criminal conduct or willful misconduct. The Released Parties are not responsible for (a) loss or misdirection of, or delay in receiving, any Rewards; (b) theft or unauthorized use of a Reward caused by circumstances beyond the reasonable control of Amazon or its representatives or agents; (c) any acts or omissions of third parties; or (d) any errors published in relation to the Rewards Program, including, without limitation, any typographical errors, errors of description, and errors in the calculation of points. Amazon reserves the right to correct, without notice to you, any errors. In no event shall the Released Parties be liable to you for any delay in or failure to perform due to causes beyond Amazon’s control, including, without limitation, any act of god, and act of war, natural disaster, terrorism, or any act or omission of a third party. The sole remedy available to you in connection with the Rewards Program (whether your claim is based in law or equity) shall be the crediting or re-crediting to your points balance in an amount no greater than the number of points at issue.
This section will survive termination of delivery partner’s participation in the Rewards Program.OTHER IMPORTANT INFORMATION YOU SHOULD KNOW
To the fullest extent permitted by applicable law, you release Amazon and its third-party service providers, affiliates, directors, officers, employees, agents and contractors from responsibility, liability, claims, demands and/or damages (actual and consequential) , arising out of or related to any activity in connection with the Rewards Program, including but not limited to, use of the Rewards Program and any Rewards that you accept.
You agree to indemnify and hold harmless the released parties from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) arising from your participation in the Rewards Program, fraud or misuse in relation to the Rewards Program, violation of any applicable law or the rights of any third party. Your indemnity is limited to the extent the loss, damage, liability, cost, or expense is caused or contributed to by Amazon.
This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Amazon.
Points are not your property and cannot be transferred by operation of law, such as by inheritance, in bankruptcy, or in connection with a divorce.
Each party is responsible, as required under applicable law, for identifying and paying all taxes and other governmental fees and charges that are imposed on that party upon or with respect to the payments under this Agreement. Amazon may deduct or withhold any taxes that Amazon is legally obliged to deduct or withhold from any amounts payable to you under this Agreement, you will provide Amazon with any documents required by Amazon to satisfy any information reporting or withholding tax obligations with respect to any payments under this Agreement.
This Rewards Program is void where prohibited by federal, state, or local law.
The laws of New South Wales govern these Rewards Terms and any dispute of any sort that might arise between the parties. Any dispute relating in any way to this Agreement will only be adjudicated in the courts of New South Wales. Each party consents to the exclusive jurisdiction and venue in these courts. Notwithstanding the foregoing, either party may seek injunctive relief in any state, federal or national court of competent jurisdiction for any actual or alleged infringement of such party's, its affiliates' and or any third party's intellectual property or other proprietary rights. The United Nations Convention on Contracts for the International Sale of Goods, and any local laws implementing the Convention on Contracts for the International Sale of Goods, do not apply to this Agreement.
Amazon may enforce the terms of the Rewards Program at any time, and any delay will not constitute a waiver. If any term of the Rewards Program is found to be unenforceable, Amazon may still enforce the other terms.
This Section will survive termination of delivery partner’s participation in the Rewards Program.
